THE CONSUMER FIREWORKS BUSINESS |

| The most pressing
issue: |

| All fireworks sold
must have a number assigned to them before they
can be imported or shipped domestically. That
number is called an EX Number. The number is assigned
by a division of the Department of Transportation
called Pipeline and Hazardous Materials Safety
Administration (PHMSA). After proper safety testing,
the manufacturer of the fireworks submits the
EX number application. It is processed and approved
by PHMSA. The number is valid for 5 years. |

| Our problem
is that PHMSA is not processing applications.
They do not answer email or phone calls. PHMSA
was being investigated by the DOT Office of Inspector
General. The result has caused them to cease all
approval activity. It is worth noting that this
investigation was prompted by infractions involving
the shipping of lithium batteries and bulk explosives,
neither of which have anything to do with consumer
fireworks. Without the approval of our new applications
and with the old numbers expiring daily, our product
line is diminishing and we are being forced out
of business. |

| This does not appear
to be a difficult problem to solve, which makes
it all the more frustrating. We simply request
that the DOT and PHMSA do the work they are required
by law to do, i.e., process the applications for
the EX Numbers on a timely basis. |

As we stated before
this is the most pressing issue, however there
are always things that jeopardize the fireworks
industry and Fireworks United is committed to
ensuring the availability of safe and legal fireworks.
